Halle Berry and ex Gabriel Aubry were married? Court docs call her his 'ex-wife'

Halle Berry's ex-boyfriend Gabriel Aubry may actually be her ex-husband, if legal documents Aubry filed to obtain a temporary restraining order against Berry's fiancé, Olivier Martinez, are to be believed.

"Extra" notes that Aubry refers to Berry as his "ex-wife" in the section of the request for a temporary restraining order asking the about the relationship of the involved parties.

The document states, "Respondent is the fiancé of my ex-wife, Halle Berry."  

No word on whether the two ever actually tied the knot.

As for the restraining order against Aubry following his Thanksgiving fight with Martinez, a judge rejected Aubry's bid to have the order removed on Tuesday (Nov. 27), per TMZ. The order, which prohibits Aubry from going within 100 yards of his daughter, Nahla, Martinez or Berry, will remain until Thursday, Nov. 29.
