Gabriel Aubry heads to court to overturn Halle Berry's emergency restraining order

Gabriel Aubry might have received a restraining order protecting him from Halle Berry's fiancé Olivier Martinez, but that doesn't mean he's been proved innocent following their Thanksgiving Day brawl. In fact, Aubry is heading into court today to ask a judge to lift the order that prevents him from seeing his daughter after Thursday's assault.

Aubry definitely came out the worse for wear in the fight, but it has not yet been proven who was at fault for the incident. Following the fight, Berry received an emergency restraining order that prevents Aubry from coming within 100 yards of her, Martinez or her daughter with Aubry, Nahla. She is reportedly fighting to make that a permanent order.

TMZ is reporting that Aubry has headed into court today to try to convince a judge to overturn that order. Berry's lawyers will allegedly be in court to oppose Aubry's efforts, and Berry might show as well.
