Nicollette Sheridan trial: 'Desperate Housewives' creator Marc Cherry off the hook for battery

nicollette-marc-cherry-abc-lawyers-up.jpg"Desperate Housewives" creator Marc Cherry can breathe a sigh of relief: The judge in Nicollette Sheridan's wrongful termination suit tossed out her battery claim, so Cherry is no longer a defendant in the case, reports TMZ.

Sheridan claimed that Marc slapped her in the face during a "Desperate Housewives" rehearsal in 2008 and that she was then fired for filing a complaint. Cherry admitted to his hand coming into contact with her face -- but only to demonstrate a scene.

The judge found that the claims didn't meet the standard for proof of battery, so Cherry's officially off the hook.

Sheridan's case against ABC, however, is pressing on.
