Christian Louboutin battle has designers seeing red

Although US District Judge Victor Marrero is an admitted fan of Christian Louboutin's shoe's signature red outsoles he doesn't feel that entitles the designer to "trademark protection."

The federal court threw out a suit on Wednesday (Aug. 10) filed by Louboutin against fellow designer Yves Saint Laurent claiming "trademark infringement, unfair competition and false designation of origin" over a line of YSL shoes that also sported a red sole.

Marrero ruled that the suit was without merit "because in the fashion industry color serves ornamental and aesthetic functions vital to robust competition."
