Lindsay Lohan sentenced to 90 days in jail, 90 days in rehab

A sobbing Lindsay Lohan was sentenced Tuesday (July 6) to 90 days in jail for a probation violation stemming from her 2007 DUI arrest. She failed to attend her mandated alcohol education courses, and didn't submit to required random drug tests, the court ruled.

Lohan will serve 30 days for her first DUI, 30 days for her second DUI and 30 days for a separate reckless driving charge. She will surrender to the court on July 20. Until that date, she must keep her SCRAM bracelet on. She'll get credit for any time already served, but not for community service hours she racked up in previous cases.

Immediately after her 90 days in jail, Lohan must complete 90 days in an inpatient residential rehab facility. Within two days of her release, she must check in with the Santa Monica probation office. As a condition of her probation, Lindsay is ordered not to consume any alcohol.

Judge Marsha Revel decided not to include the results from Lohan's SCRAM bracelet when considering the sentence, so the fact that something set off the bracelet at an MTV Movie Awards after party Lohan attended didn't factor into the decision.

Also disregarded was Lindsay's father, Michael Lohan. He requested a private meeting in the judge's chambers, but Revel suggested that he send a letter to the court instead.

"I just wanted to take a minute to say that as far as I know, I was being in compliance with my program. When I asked to leave town, they would give me permission to leave town. I wasn't expecting any special treatment aside from the understanding that I have to provide for myself, I have to work," Lohan told the judge prior to sentencing. "It's just been such a long haul and I don't want you to think I don't respect you on your terms because I really did think I was doing what I was supposed to do."

"The court doesn't buy that at this time," the judge responded.

As the sentence was carried out, Lohan sobbed to her lawyer, Shawn Chapman Holley, and cried, "What?" several times. Holley asked Revel to remove Lindsay's SCRAM bracelet until she reports to jail on July 20, but the judge refused. When the lawyer suggested that Lohan would take daily tests, the judge said that alcohol doesn't remain in the blood stream long enough for tests to be accurate, so the bracelet stays on until Lohan goes to jail.
