Halle Berry and Gabriel Aubry split, custody agreement in the works

Halle Berry may be one of the most beautiful women in the world, but she's been consistently unlucky in love. TMZ reports that Berry and model Gabriel Aubry have decided to part ways. The couple has been dating since November 2005 and they have one daughter together, 2-year-old Nahla Ariela Aubry.

Though Berry and Aubry never married, Berry went to a divorce lawyer three weeks ago to begin the process of working out a short-term custody arrangement for Nahla. Berry has been divorced twice, from athlete David Justice and rocker Eric Benet.

No long-term custody agreement has been reached or put into writing, but the couple apparently plans to share custody of their daughter. Sources say that Berry and Aubry are "working well together" despite the fact that they have been having relationship trouble for quite a while. According to RadarOnline, the couple's problems stemmed from their 9-year age difference - he's 34, and she is 43.

Aubry, who sources say earns $700,000 per year, is not asking for financial support from Berry. He has, however, asked to take ownership of their home in Canada, which he has been making payments on since Berry paid the deposit.
