Alex Rodriguez responds to Cynthia's divorce request: Ahem, PRENUP!

Alex Rodriguez finally responded to his wife Cynthia's legal divorce papers.

Four weeks after Cynthia Rodriguez filed her divorce request, the Yankees star player has warmed up and stepped up to bat.

According to People,  his legal response -- to be filed today -- admits the marriage is "irretrievably broken."

It also mentions that Florida is a "no-fault state,"  brings up her prenup (he says Cynthia voluntarily signed it a month before the 2002 wedding) and decries any mention of alleged "extramarital affairs and other marital misconduct."

While the Rodsters prepare for a court battle, Madonna and Guy Ritchie are attending cabala services and getting couples' spiritual counseling, which sounds like a much less expensive endeavor.

C-Rod wants their $12-million Coral Gables home, the two daughters and a cut of his earnings during the marriage.

A-Rod seeks shared custody and parental responsibility for the children's "wealth, health, education and religious upbringing." No mention of cabala, but, one has to wonder, since he and Madonna bonded over his interest in the spiritual teachings.

A-Rod acknowledges he should pay child support and asks the court to determine a fair amount.

What do you think? Should the prenup hold since his vows did not? Is Cynthia in the right to get her share of his earnings? Or she just using the Madonna publicity to finally take him to the proverbial cleaners?

I get the feeling that this divorce is not going to be a quickie and the only people getting rich will be this couple's lawyers.

Umm... isn't the whole point of a prenup to be a contingency for when the vows do not hold?

Why do couples who commit these sexual missteps always have to put the children in the middle and mess with their lives. Alex did wrong and Cynthia wants out. Fine but leave the children alone. No matter what the psychologists say it does affect the children for the REST OF THEIR LIVES.

Cynthia quit being so selfish and wanting to hurt Alex by using the kids as a fighting tool. By doing so now you are wrong and certainly loose all of my sympathy.

The prenuptial agreement is a contract into which Mrs. Rodriguez entered willingly. Barring some other finding that would render it otherwise unenforceable, it should be enforced. Whether Mr. Rodriguez would win the Husband of the Year Award is irrelevant; the reason for prenuptial agreements is so as to be precised about who gets what in the event of divorce.

She should get what she's asking for. He's got a few more good years left and will no doubt be in another family in the next 5 years. She knew his stripes when she married him and stuck by him because of who he was - she deserves what she's asking for, God knows how many women she's had to smell on him during their 10+ years together. It was a business deal as much as a marriage and a deals as deal!

Um, without knowing what the prenup says, how can we judge what's fair here? Most prenups only cover earnings before the marriage, but not all.

A-Rod certainly should pay child support, and morally, Cynthia should be entitled to a portion of his earnings since their marriage. Of course, like I said, we don't know what she may or may not have agreed to in the prenup.

And I don't think A-Rod had an affair with Madonna (affair of the heart is bogus!). I'm pretty sure it's mostly those strippers who derailed this train.

well alot of prenups have a clause that says if someone cheats then it is null and void. I don't know what I think. It doesn't matter, it seems she's into someone else with money anyway. No matter what happens her and the kids will be taken care of.

The pre-nup should hold. The fact that either spouse may have broken their vows is the entire reason for a pre-nuptial agreement. High income individuals, couples with enormous disparities in skills and earning abilities, or those with inheretances and substantial estates will continue to be victimized for being financial well off if pre-nuptials did not exist.

She could have chosen not to sign the pre-nuptial agreement.

The pre-nuptial agreement should stand.

It ALL depends on what the prenup says and what what it says means in the State of Florida. And, given that, how explicit and outrageous any actual evidence of extra-marital activity is able to be brought before the court. And of course, the disposition of the judge, and the relative skills of the lawyers.

C-Rod signed the prenup. If she can't deal with his extracurricular activities then she should get what's been spelled out for her. She should have realized that a stallion like that is gonna want to spread himself around. Go A-Rod.

Child support but why should he give up his earnings? So she can keep doing nothing the rest of her life? Get a job.
