Janet Jackson wardrobe malfunction worth a second look in court
Janet Jackson's exposed breast requires another look says the Supreme Court, which ordered a federal appeals court Monday to reexamine its previous ruling in favor of CBS regarding the infamous "wardrobe malfunction" that took place during the 2004 Super Bowl halftime show, reports the LA Times.
Five years ago, on national television, pop star and Justin Timberlake collaborated on his song "Rock Your Body," which ends with the lyrics "'Cause I gotta have you naked by the end of this song." At that point, Timberlake ripped part of Jackson's top, which was supposed to only show some underclothes, but instead took all the cloth with it, leaving her breast bare.

Well, now it appears tha the 3rd U.S. Circuit Court of Appeals in Philadelphia is tasked to consider reinstating the $550.000 fine (that had been thrown out) that the FCC had wanted to impose on CBS for the revealing performance.
The decision comes on the heels of the high court ruling last week that upheld the FCC's policy of fining over one-time, "fleeting" use of curse words on live TV.

Oh, for Pete's sake. It's been 5 years...the FCC needs to get over it. The fine was stupid then and it's still stupid now. And the two cases are completely different. For better or worse, curse words are such a common part of our daily use that it should be ***umed that one is eventually going to be used in a live broadcast and necessary precautions should be taken...and if you don't, then you get fined. But things like a "wardrobe malfunction" aren't expected and thus precautions can't be planned for...and thus no fine should be levied.
